We are not a substitute for a traditional full-service law firm for contested litigation. Our services are strictly designed for spouses who are in complete mutual agreement to dissolve their marriage amicably.

Section 2

Mandatory Mutual Agreement

• Mutual divorce requires the absolute, voluntary, and uncoerced consent of both the husband and the wife under applicable laws.
• We do not coerce, pressure, or convince uncooperative spouses. Because divorce is a deeply personal and sensitive matter, our firm maintains a strict policy against sending intrusive reminder emails or making unsolicited phone calls regarding consent.
• If a spouse fails to respond or hesitates, it is the sole responsibility of the initiating client to coordinate directly with their spouse or copy us on direct follow-up communications.

Section 3

Client Responsibilities and Accuracy of Information

• Single Form Submission: Only one spouse must fill out and submit the online mutual divorce form. Duplicate submissions by both spouses are strictly prohibited and will result in administrative errors.
• Truthful Disclosures: Clients are solely responsible for providing accurate, complete, and truthful information regarding personal details, asset settlements, maintenance terms, and child custody arrangements. Any misrepresentation of facts or hidden liabilities may adversely affect the court proceedings.
• Compliance with Deadlines: Clients must adhere to the structured timelines and respond to legal communications promptly. All payments carry a strict 6-month validity period, after which tasks expire and must be re-initiated.

Section 4

Court Proceedings and Judicial Discretion

While we meticulously draft petitions, prepare settlement terms, and coordinate court filings (1st Motion and 2nd Motion), the final granting of a divorce decree rests entirely with the discretion of the presiding family court judge. We are not responsible for delays, statutory cooling-off periods, or outcomes resulting from judicial directives, court holidays, or last-minute changes of heart by either party.

Limitation of Liability

Mutual Divorce Online, its founders, and associated advocates shall not be held liable for any direct, indirect, or consequential damages arising from delays caused by uncooperative spouses, delayed court hearings, or incorrect information provided by the clients during the form submission phase.

Advocate Assignment and Professional Representation

Depending upon the jurisdiction and requirements of the matter, the Firm may coordinate the involvement of an advocate or legal professional for representation or procedural work. The identity of the assigned advocate may depend upon jurisdiction, availability, professional suitability, conflict considerations, Court requirements, and other legitimate professional factors. An advocate may be reassigned where reasonably necessary for professional, administrative, availability, conflict or other legitimate reasons, subject to applicable professional obligations.

Right to Decline or Discontinue a Matter

The Firm may decline to commence or may discontinue professional work where there is a legitimate reason to do so, including circumstances involving conflict of interest, professional or ethical obligations, jurisdictional limitations, inability to verify material information, non-cooperation, persistent failure to provide required documents, misuse of legal services, unlawful instructions, material misrepresentation, or other circumstances in which continuing the engagement is not professionally or legally appropriate. Any discontinuation will be handled subject to applicable professional obligations and applicable law.
