Where children are involved, the settlement needs primary residence stated clearly, a visiting schedule with specific days and holidays, how school fees and medical expenses are divided, and how major decisions will be made. Vague terms generate court questions.
If property is in both names, the MoU must state what has been agreed — who keeps it, whether it is sold, and the timeline for completing the transfer. The MoU creates the obligation. A registered deed after the decree actually transfers the title.
