How Long an Online Mutual Divorce Takes

Online preparation reduces delays caused by document collection and repeated office visits, but it cannot eliminate the statutory requirements or control the court's own schedule. Under Section 13B(2), the Second Motion ordinarily follows six months after filing and no later than eighteen months. The Supreme Court has recognised that the cooling-off period can, in appropriate cases, be waived, but that does not mean every case qualifies. A better question than "how fast can you promise" is whether the case has been prepared correctly enough that avoidable delays aren't being created by the legal team itself.

What Happened

A couple had filed a mutual divorce petition. The matter was referred to mediation, but the parties did not appear, reportedly because they were trying to settle things between themselves. The mediation centre reported non-settlement due to their absence. The trial court, noting the parties seemed to be "trying for reunion," dismissed the petition on its own within nine months, well short of the eighteen-month window.

What the Court Held

The Karnataka High Court set that order aside. It held that under Section 13B(2), parties have a full eighteen months from the First Motion to move the Second Motion, and the trial court cannot unilaterally close the case within that window simply because the parties appear ambivalent. The petition remains alive until either the eighteen months expire without a Second Motion, or the parties themselves formally withdraw it.

What It Means for Mysuru Couples

If you go through a period of uncertainty during the cooling-off period, and some couples genuinely do, your petition doesn't disappear. It stays on record. You can move the Second Motion at any point within eighteen months of the First Motion without the court having closed the matter in the meantime.
