NRI Divorce · Documents Checklist

What Documents Do You Actually Need for an NRI Mutual Divorce?

Most NRI couples worry they are missing something before they even start. Here's the good news: you don't need a single document ready to begin. Either of you can submit the online form today, and documents only come into the picture once mutual consent and settlement terms are confirmed. Here is exactly what's needed, when it's needed, and what to do if something is missing.

The Checklist

The 5 Documents You Need

You won't need any of these to submit your form and begin the process. Once mutual consent and settlement terms are confirmed between both of you, we move into the documentation stage, and this is what we'll ask you for.

1

Indian Address Proof, Both Spouses

An Aadhaar card, voter ID, passport, or utility bill showing an Indian address for both husband and wife establishes the court's jurisdiction. It does not need to be your current address, it can be the address where you last lived together or where the marriage was registered.

Used at: Documentation stage
2

Foreign Address Proof, Spouse Abroad

A residency permit, utility bill, or bank statement issued within the last three to six months, showing your current address abroad. This confirms your NRI status and is what allows the sPOA and video-hearing route to apply to your case at all.

Used at: Documentation stage
3

Marriage Invitation Card or Religious Certificate

Your wedding invitation card, or a certificate from the temple, church, gurudwara, or other institution where the ceremony took place. Photographs of the ceremony are also accepted as supporting evidence alongside either of these.

Used at: Documentation stage
4

Marriage Registration Certificate

If your marriage was registered, whether under the Hindu Marriage Act, the Special Marriage Act, or with your local municipal authority, include this certificate. If it was never registered, item 3 alone is generally sufficient, see the FAQ below.

Used at: Documentation stage
5

Address Proof of Your sPOA Nominee

Whoever you appoint as your Special Power of Attorney representative in India, usually a close family member, needs to provide their own address proof, such as an Aadhaar card or utility bill, to be formally named in the sPOA document.

Used at: Documentation stage

That's the Complete List

No income proof, no tax documents, no employer letters. Alimony and property terms are agreed between you and your spouse directly and documented within the petition itself, not proven through separate paperwork.

Don't Have Something on the List?

What to Do If a Document Is Missing

These situations come up often, and none of them stop your case from moving forward.

Your marriage was never officially registered

Very common, especially among couples married in the 1990s and 2000s or married primarily through a religious ceremony. Your invitation card, ceremony photographs, and a letter from the officiating institution are generally enough to establish the marriage for a mutual consent petition.

You and your spouse no longer share an Indian address

The court looks at where you last lived together, or where the marriage was registered, not your current address. We identify the correct jurisdiction during your initial case review, before any document is finalised, so this never becomes a last-minute problem.

Your foreign address proof is older than six months

Not a problem on its own. Pair it with one more recent document, even something like a recent courier receipt or a current utility bill, to show continuity of residence at that address.

Your sPOA nominee doesn't have ready address proof

Most family members already have an Aadhaar card or voter ID on hand. If genuinely none exists yet, we advise on the fastest document to arrange specifically for this purpose so it doesn't hold up your filing.

One Detail That Depends on Where You Live

Getting Your sPOA Recognised Abroad

Before your Special Power of Attorney can be used in an Indian court, it needs to be notarised and authenticated in your country of residence. The exact steps for this vary by country, and we tell you precisely what applies to yours during the documentation stage.

Countries With a Simpler Process

In countries such as the USA, UK, Australia, Canada, Germany, New Zealand, Hong Kong, and Japan, your local authorities offer a single, government-recognised certification step for documents headed to India.

Countries That Require Embassy Attestation

In countries such as the UAE, Saudi Arabia, Qatar, Kuwait, and Indonesia, your sPOA needs to be notarised locally and then attested by the Indian Embassy or Consulate in your country of residence.

Not sure which applies to you? Call or WhatsApp us and we'll walk you through the exact requirement for your country once you're ready for the documentation stage.

FAQs on NRI Divorce Documents

No. Either spouse can submit the online form to begin, before any documents are gathered. We first confirm mutual consent between both parties by email and finalise settlement terms. Only once that is agreed do we move into the documentation stage, where we collect the documents described on this page to draft your joint petition and arrange the sPOA.

Yes, if a document such as your marriage certificate or a religious institution's record is in a regional Indian language, courts generally accept it alongside a certified English translation. We arrange this translation as part of document preparation, so you don't need to source it separately.

Courts typically expect address proof issued within the last three to six months, such as a recent utility bill, bank statement, or residency permit. Older documents are usually still fine alongside one recent one that shows continuity of residence.

This is common and doesn't stop you from filing. A marriage invitation card, photographs, or a certificate from the temple, church, gurudwara, or other institution where the ceremony took place is generally sufficient proof of marriage for a mutual consent petition.

A registered rental agreement is usually accepted, both for Indian and foreign address proof. Utility bills, bank statements, and government-issued residency documents work just as well. What matters is that the document is current and clearly shows your name and address.

This is usually easy to resolve, since most family members already have an Aadhaar card, voter ID, or utility bill on hand. If they genuinely have none, we advise on the fastest document to obtain for this specific purpose so it doesn't delay your filing.

Scanned copies are enough for the initial review and petition drafting. Notarised or embassy-attested originals are required only for the Special Power of Attorney and certain supporting documents, and we specify exactly which ones before you visit the embassy or a notary.

That's fine. Courts look at where you last lived together or where the marriage was registered, not your current address. We identify the correct jurisdiction from your marriage and residence history during the initial review, before any documents are finalised.
